1. Initial advice

Before arrival in Germany

a) Providing the foreign staff member and the HR manager with advice on the phone and in writing regarding the visa process;

b) Sending a complete visa application package to the foreign staff member for submission to the German Foreign Mission;

c) Providing the foreign staff member with help by phone in filling in the visa application form (thus ensuring that the application is completed correctly);

d) Completing the application for a work permit-EU and the application for a residence permit including the permission to work;

e) Revising, and where necessary improving, all documents received from the foreign staff member and the domestic employee that are required for submitting an application;

f) Evaluating the various legal provisions under which the necessary permits can be issued in a specific case; drafting a detailed legal memorandum to the authorities involved (so that the applications immediately get on the right procedural track);

g) Maintaining continuous contact and discussions with the German Foreign Mission and the local public authorities during the application process so as to minimise the risk of the applications being rejected;

After arrival in Germany:

h) Extending the work visa (since a work visa is only issued for a maximum of three months, the visa must be extended in Germany in the form of a residence permit if the foreign staff member is to work in Germany for more than three months);

i) Coordinating the last administrative steps with a relocation service (if a relocation service is to be used). After the foreign employee enters the country he or she must register his/her place of residence with the Residents Registration Office (Einwohnermeldeamt) and collect the residence permit from the Immigration Office (Ausländerbehörde). The foreign employee may also authorise a relocation service to do this. The task of the relocation service is the actual physical collecting of the permits only; we take care of the legal work.

2. Extensions

We also take care of the annual extension procedures for our clients. This can also include the screening of the expiry dates of the permits for our clients’ foreign staff members so that our clients do not need to worry about one single permit expiring.

3. Advice in connection with company acquisitions or the formation of new companies

We help our clients with rewriting or adapting the permits. This is necessary if our clients acquire new companies or parts of companies and continue to employ their foreign employees. In this case new permits must be applied for. The same applies when foreign employees within the company are transferred to other companies or newly formed companies. We ensure that these tasks are not forgotten but that they, along with many other essential tasks, go smoothly and without delay.

4. Training/Presentations

We have been holding presentations for some years now in collaboration with various organisations, including the American Chamber of Commerce, on the subject of “Law Relating to Residence and Work Permits,” particularly in connection with the Immigration Act which came into force on January 1st 2005. In addition, we also offer training for our clients in the form of in-house seminars.
